Terms of use and licence

1. Who we are and what these terms cover

KeyFall Piano™ is made and run by Kevin Wilkinson, trading as KeyFall Piano, 41 High Street, Langford, Biggleswade, Bedfordshire, SG18 9RU, United Kingdom, England — "we", "us". Email: support@keyfallpiano.com. These terms cover the KeyFall Piano app for Windows, keyfallpiano.com, the members area, and KeyFall Piano Live lessons (together "KeyFall Piano"). By installing the app or using the site you agree to them. Our Privacy policy (keyfallpiano.com/privacy) and Refund policy (keyfallpiano.com/refund) are part of the deal.

Purchases are sold by Lemon Squeezy, LLC as merchant of record; their terms of sale apply to the payment itself, and these terms apply to what you get.

2. Who can agree to these terms

You must be 18 or over to hold an account or buy anything. Children use KeyFall Piano through a profile on a parent's, guardian's or teacher's account; the adult who holds the account is responsible for what happens on it and agrees to these terms on the child's behalf. A teacher who pairs with a pupil under 18 confirms that they are entitled to teach that child and that a parent or guardian has approved through the link we send.

3. The licence to use the app

We grant you a personal, non-exclusive, non-transferable licence to install and use the KeyFall Piano app on computers in your own home or teaching studio, for learning, teaching and playing the piano. You may not sell, rent, share your account, or redistribute the app or its content, remove notices, or try to defeat the licence checks. You may not take the app apart except where the law lets you (for example, to make it work with other software, as UK copyright law allows). The app keeps itself up to date: it downloads new versions in the background and installs them when you next close it, and online features need the current version.

What is free, for good: the app itself, all of Grade 1 with its own rewards, playing with any MIDI keyboard and the built-in piano or your own VST instruments, the visualizer, the 19 themes everyone has, and every theme or pack you have bought. What the subscription unlocks: Grades 2 to 8 and their Final Tests, the Ear Training Lab, Sight Reading Drills, Chord Orbit and the Harmony Lens, the Composition Lab, the MIDI editor, opening your own files, the Theme Designer, KeyFall Piano Live and the members area, and the themes earned in Grades 2 to 8. The free week: when you first sign in you get seven days of everything, no card needed, once per person.

4. Buying, renewing and cancelling

5. Your account

Sign-in is by a six-digit code emailed to you; keep your email account secure and sign out of computers you no longer use. You are responsible for the profiles on your account and for anyone you let use it. One account per email address; do not make accounts with throwaway addresses to repeat the free week.

6. Children, parents and teachers

7. Your content

You keep ownership of everything you upload, record, write or share (files, recordings, messages, comments, pieces, pages). You give us the permission we need to store it, send it to the people you choose, and show it where you asked us to — and nothing more. You are responsible for it: only share music you wrote yourself or an arrangement of public-domain music (the members' pool rule), only upload files you have the right to share, and keep comments and messages civil. We may remove content that breaks these terms or the law, or on a credible complaint, and we may keep a copy where the law requires.

8. Behaving well

Do not use KeyFall Piano to harass, bully, deceive or endanger anyone, to share unlawful or hateful material, to collect other members' data, to send spam, to break in to or overload our systems, or to get round the licence. Anyone behaving towards a child in a way that worries us will be removed and, where appropriate, reported.

9. Our content

The app, its lessons, grades, pieces, recordings, videos, themes, artwork, text and the KeyFall Piano™ name are ours or licensed to us and are protected by copyright and trade-mark law. You may use them within KeyFall Piano for your own learning and teaching. The Salamander Grand Piano and drum samples are used under Creative Commons licences and other open-source components under their own licences — they're named in the app, under Settings ⚙ → About KeyFall Piano, and in the manual's Credits. Your own VST instruments are covered by their makers' licences, not ours.

10. Live lessons and online features

Online features need an internet connection and a current version of the app. We do our best to keep them running but cannot promise they will never pause or change; we may improve, replace or retire features, and will give reasonable notice before withdrawing anything you have paid for. KeyFall Piano is at its best with a MIDI keyboard.

11. Health and safety

Playing along to music can get loud: keep volume at a sensible level, especially for children with headphones. Take breaks.

Flashing lights. Some themes use animated and flashing visuals; if you or your child is sensitive to flashing lights, use the gentle variants (chosen automatically for younger profiles) or a plain theme. The Beat Visualizer in the MIDI editor is different: it flashes the whole screen hard and fast in time with the drums. Do not use it if you, or anyone who can see the screen, has epilepsy, has ever had a seizure, or feels ill from flashing or strobing light. It is switched off unless an adult turns it on, it warns before it starts, and it is not available on a child's profile. If you feel unwell while using it, look away and switch it off at once.

12. Ending things

You can stop using KeyFall Piano and delete your account at any time (email us until the button arrives). We can suspend or close an account for a serious or repeated breach of these terms, after telling you why, unless the breach is dangerous or unlawful. On closure you lose access to the subscription and to content on our servers; purchases already made are refunded only as the Refund policy says; sections 7, 9, 13 and 14 continue to apply.

13. Our responsibility to you

If we do not meet the standard the law requires, we are responsible for the foreseeable loss or damage you suffer as a result. We do not exclude or limit our liability for death or personal injury caused by our negligence, fraud, or your rights under the Consumer Rights Act 2015 — including that digital content must be of satisfactory quality, fit for purpose and as described, and that if our digital content damages your device or other digital content because we failed to use reasonable care and skill, we will repair the damage or compensate you.

Beyond that, we are not responsible for business losses (the app is sold for home and small-studio use), for losses we could not reasonably have foreseen, for what teachers, pupils or other members do, or for third-party services you connect. We are not responsible for events outside our reasonable control, but we will do what we sensibly can to reduce their effect.

14. The law and disputes

These terms are governed by the law of England and Wales and the courts of England and Wales can deal with any dispute. If you live in Scotland or Northern Ireland you can also bring proceedings in your own courts, and if you live in the EU you keep the protection of your own country's mandatory consumer law and courts. If something goes wrong, please email us first — we would much rather fix it.

15. Changes to these terms

We may update these terms as KeyFall Piano grows or the law changes. We will post the new version with its date and, for changes that affect your rights, tell account holders by email or in the app at least 14 days before they take effect. If you do not agree with a change you can cancel before it applies.
